ABSTRACT
It is often said that the reason why FCFM in Japan has been well developed is due to a historical development of a fishing right, which emerged during her feudal era. This is completely a misunderstanding. In 1945, when Japan was defeated from the World War II, everything was under the control of central and local governments. There was no democracy at all. Japan was occupied by the Allied Force for seven years from September 1945 to April 1952. During this period, the main policy of the Occupied Force was to make Japan a real democratic country. Following such a policy, the contents of her national fishery law was throughly revised in order that fishermen are entitled to participate in the planning with regard to the use of fishing area and fishery resources atthe utmost democratic manner. This gave an incentive to fishermen to create their own community-based fishery management. Before 1945 there was no FCFM at all, and conflicts among fishermen often happened with respect to the use of resources.
